These are the terms you agree to when you order food from us through this website. We’ve written them in plain English rather than legal language, because they’re for you, not for lawyers. Nothing here takes away the rights the law gives you as a consumer.
Who we are
This website is run by Muhammad Mustafa Chohan, trading as Spice Hut. We’re a sole trader, not a limited company — so there’s no company registration number and no registered office.
Our shop, and our address for any formal correspondence, is 128–130 Bradshawgate, Bolton BL2 1AY.
You can reach us on 01204 528885while we’re open, or by email at spicehutbolton@gmail.com. Email is the quickest way to reach us about anything that isn’t urgent; if your food is on its way, please phone.
How an order becomes an order
Putting items in your basket and paying is an offer to buy — it isn’t yet an agreement. The contract between us is formed when the kitchen accepts your order, which normally happens within a few minutes of you paying. You’ll see the order move from “Order received” to “The kitchen is on it” on your order page.
This matters because of what happens if we can’ttake your order — we’re too busy, something has run out, or we’re about to close. If the kitchen rejects an order, no contract is formed and your payment is refunded in full, automatically. You don’t need to ask us for it. See our refunds and delivery policy for how long that takes to reach your bank.
Prices and payment
The price shown against each item is the price you pay for it. If you’re having your order delivered, the delivery fee is shown separately in your basket before you pay, and the total on the payment screen is the full amount that will leave your account. There are no booking fees, service charges or other extras added afterwards.
Prices can change — but never after you’ve paid. The price we charge is the one shown when you place the order.
Payment is by debit or credit card and is handled by Stripe. We are set up to take cards issued in the United Kingdom; if yours was issued elsewhere, your payment may be declined. Your card number goes straight from your browser to Stripe and is never seen by, or stored on, our systems.
Allergies and intolerances
This website is not a source of allergen information, and you should not rely on it to decide whether a dish is safe for you. We don’t publish ingredient or allergen listings here, and the descriptions and photographs on the menu are not a complete account of what a dish contains.
If you have a food allergy or intolerance, please phone us on 01204 528885 before you order and speak to us about it. You can also leave a note with your order, and it will reach the kitchen — but a note is not a substitute for that conversation, and it cannot guarantee an allergen-free dish.
We prepare all our food in one kitchen, where nuts, cereals containing gluten, milk, eggs, sesame, mustard, soya, celery, fish, molluscs, crustaceans, sulphites and lupin are handled. We cannot promise that any dish is free from traces of any of them.
Menu photographs and descriptions
The photographs on our menu are there to show you what a dish is like. They’re not a promise about portion size, exact presentation or the precise garnish on the day. We may also change a recipe, or substitute an ingredient of equivalent quality, without updating every photograph.
We try hard to keep the menu accurate. If something is out of stock after you’ve ordered, we’ll phone you rather than silently leave it out.
Changing or cancelling an order
You can cancel free of charge at any point before the kitchen accepts your order— phone us straight away on 01204 528885and we’ll refund you in full.
Once the kitchen has accepted, your food is being cooked to order and we can’t usually cancel it. Phone us anyway — if we’ve not started, we’ll do what we can.
You may have heard of a 14-day right to change your mind when buying online. By law that right does not apply to freshly prepared food, because it’s perishable and made to order. We’re telling you that plainly because the law requires us to, and because it’s better you know before you order than after. It doesn’t affect anything else on this page, and it doesn’t affect your rights if something is wrong with your food.
If something goes wrong
Phone the shop on 01204 528885and we’ll put it right. Our refunds and delivery policy sets out exactly what we do about missing items, wrong items, a problem with the food, and a delivery we can’t complete.
Our responsibility to you
Nothing in these terms removes or reduces your legal rights as a consumer. Under the Consumer Rights Act 2015 the food we sell you must be of satisfactory quality, fit for purpose and as described. We can’t exclude that, and we’re not trying to. We are also fully responsible for death or personal injury caused by our negligence, and for fraud — no wording here limits either.
Beyond those rights, and to the extent the law allows us to limit anything at all, our responsibility for any single order is limited to what you paid for that order. We’re not responsible for indirect or knock-on losses — for example a missed appointment, or the cost of buying food elsewhere — that we couldn’t reasonably have expected when you ordered.
We keep this website working as well as we can, but we can’t promise it will always be available or completely free of errors, and we don’t give any guarantee about it beyond what the law requires of us. If the website is down, the shop is still on the end of the phone.
Using this website
Please use the site for what it’s for: looking at the menu and ordering food. Don’t try to break into it, place fraudulent or deliberately false orders, or interfere with other customers’ use of it. If you do, and that causes us a direct loss, you’re responsible for it.
That’s the whole of it — it applies to deliberate misuse and nothing else. Ordinary use of the site, including getting something wrong by accident, carries no such liability.
Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one published when you placed it, and the date at the top of this page tells you when it last changed.
Which law applies
These terms are governed by the law of England and Wales, and any dispute between us can be dealt with by the courts of England and Wales.
